Using SPUN

SPUN offers the best content from thousands of sources. Every article you find in SPUN is hand-picked by a dedicated team of real humans (who get a little help from our fancy under-the-hood Internet monitoring system). SPUN 2.0.0 is for retina iPhones and iPod Touches with iOS 6.0 or higher.

SPUN with Local content. Anyone can use SPUN and get the best stories on the web, but if you live in a supported city you will also get the best stories about your city. For this enhanced local experience, agree to allow Location Services when you first launch SPUN, or go to your phone’s Settings>Privacy>Location Services and allow SPUN to find your location.

The Cube. All SPUN stories are on the cube – a four-sided object you can scroll or rotate. Swipe left and right to view other categories.

Swipe upwards to see more stories. The most recent stories are at the top.

There are four sides of the cube: Top Stories, Entertainment, Intelligence, and Lifestyle.  “Top Stories” is a mix of the best stories pulled from the other categories. To read a story, just tap on any tile with a headline and image and the story view will appear.

Story View. All story views have a back button (top left), Favorite button (top right), and Share button (bottom right). The publisher name and story title always appear as well – tapping on either of these will open the original article in a new window within SPUN. You can swipe left or right to side-scroll to the next story that appears on the cube: Swipe right-to-left to view a story that’s lower on the cube, left-to-right to view one that’s higher up.

 


Favorite button.  The Favorite button appears in the story view as well as on the cube. Tapping Favorite will save the story in your Favorites list in Settings (see more below).  You can show your Favorites on your Facebook timeline by connecting to Facebook.  Go to Settings>Facebook and tap on “Post Favorites to Timeline”.  You can also Tweet your Favorites by going to Settings>Connect to Twitter.  If the story you favorited has a map in it, you’ll get a push notification if you happen to pass nearby one of the venues mentioned in the story.

Sharing. SPUN is all about sharing great stories with friends.  Tap on the share icon (bottom right corner) and it will unfold, displaying options to share via Facebook, Twitter, email, or Messages (SMS or iMessage).

Back-to-cube button. The button in the top left corner (black triangle) will return you to the cube.

Map View. If you live in a supported city with local content, you may see stories that are pinned to a map in your version of SPUN.  These stories will have a map strip at the top of the story view, like the story below.

Tapping on the map strip will open the expanded map view, pictured below.

Tapping on the ‘car’ icon in the callout will offer driving directions to the location, while tapping the (i) will zoom in on the relevant part of the story in the story view.  Tap on one of the other pink cubes to see the name of the venue.  The “locate me” button in the bottom left shows you as a blue dot on the map.  The (x) in the top right closes the map view.

Settings. All of SPUN’s settings can be accessed by tapping the three-line icon in the top left corner of the cube.  Most of the settings here should be self-explanatory, but we’ll highlight a few:

 

FAQ

How do I delete a story from my Favorited list?

Simply open the Settings screen, then Favorites, and tap the heart icon on the story you want to remove.  An alert will ask you if you’re sure you want to remove the story from your Favorites.

My location icon is on all the time. Why is that?

If you’ve Favorited a story that’s pinned to a venue, SPUN will check to see if you’re near the location of a Favorited story.  As a result, the locator icon in your status bar will be on.  This shouldn’t have a significant drain on battery, however, since it only checks periodically.

How often are new stories posted to SPUN?

Our editorial team posts articles throughout the day. Typically you will be able to find one new article every ten minutes during the week, and a handful of new articles posted more sporadically throughout the weekend.

Can I program SPUN to only show me stories in categories I care about?

SPUN learns your behavior as you use it and will adjust the blend of stories in the app over time. Look for our next big update (coming toward the end of June, 2013), which will allow for more interactive personalization.

Our Team

Andy Hunter is the CEO of SPUN. He is the co-founder of Broadcastr, a Brooklyn-based startup creating a platform for geo-targeted content distribution and discovery on mobile devices. Mr. Hunter also co-founded Electric Literature, which has won accolades and awards for its innovative use of digital publishing and promotion. He has served as Editor-in-Chief of various publications, including Electric Literature, Mean Magazine, and Lollapalooza Magazine. Prior to becoming an entrepreneur, Mr. Hunter was an IT consultant for entertainment companies such as Disney and MGM.

 

Scott Lindenbaum: President & COO

Scott Lindenbaum is the President and COO of SPUN.  Scott has been covered by CNN, MSNBC, and FOXnews, and has appeared in the New York Times, Wall Street Journal, and numerous other outlets. For ten years Scott was a halfpipe snowboard competitor sponsored by Burton Snowboards. He holds an MFA in creative writing, has studied Behavior Design with Stanford Human Interaction professor BJ Fogg, and is currently working with Apple on the UI design of future SPUN iterations.

Rick Mangi is CTO at SPUN and is responsible for developing the backend services. He has been active in the New York software development community for over 15 years developing web technology for numerous startups and large companies. Most recently he was at MTV where he was Director of Technology for Nick Jr. and for the core platform team supporting hundreds of websites. Rick has a B.A. from The University of Colorado in Computer Science and Sociology. The father of three daughters, he also enjoys coaching soccer and teaching Lego Robotics.

Peter Grates works on iOS development for SPUN. He holds a CS degree from Rutgers and has 14 years of experience as a programmer, with frontend, backend, CSS, and Objective C proficiency. Peter is the reason that SPUN has a 3D interface.

 

Ilya Lyashevsky. Currently Director of Mobile Development at Broadcastr, Ilya Lyashevsky previously co-founded Good To Know, Inc. which created Storied, an educational suite of software aimed at helping students learn vocabulary by reading original stories. He also headed mobile development at Electric Literature, helping it become the first magazine of its kind to be published on the iPad, and using its iOS publishing platform to create apps for such organizations as Human Rights Watch and the Kenyon Review.  Prior to that he had worked as a senior software developer at Motorola, upon graduating with a BS and MS in computer science, as well as a minor in creative writing, from Stanford University. He is, in addition, a published fiction author and a PhD candidate in Cognitive Studies at Columbia Teacher’s College.

Renato Castilho is a veteran designer and brand development specialist, who in the past 15 years has been responsible for creating and leading the implementation of visual systems for NickJr, iVillage, General Mills and Cadillac, among many. As owner of Write Down Everything he collaborated with SPUN to conceive and create our logo, app user interface and overall brand assets. He’s also known for shredding the electric guitar so loudly he “had” to move to the burbs, where he lives with his wife and their three children.

 

Robb Ware is Project Manager at SPUN.  He holds a Bachelor’s in Music Composition and Production from SUNY Purchase and has studied Product Design at NYU.  Robb spent nearly 4 years at Apple Retail in the NYC metro area in a number of roles, with a focus on training, visual merchandising and back-of-house operations. He designed and built sustainably-produced lighting at a Brooklyn factory during that time, as well as volunteering for the design and build of a YMCA rooftop garden.  His love of great design and human-focused technology inform his work on product development within the company.

Leanne Butkovic is a Wrangler of Content and Producer of Good Vibes at SPUN. She is a 2012 graduate from the University of Missouri-Columbia’s School of Journalism where she reported, produced and edited for myriad of local media: Mid-Missouri Public Radio, Vox Magazine, Newsy.com and KCOU student radio. She also wrote a comprehensive guide titled, “So, You Were Teargassed?” as an intern at VICE one summer. Along with editorial prowess and devout adherence to AP Style, Leanne would say she’s “pretty OK” at web design, discovering cool music and jokes.

David Lumb might be one of the last writers to say he got his start in print journalism. After graduating from UC Irvine as Editor-in-Chief of the New University student newspaper, he interned at KPCC Public Radio, reported for their South Los Angeles cell OnCentral.org and the local chapter of Patch.com, tested games for 343 Studios in Seattle, and interned at Animal NY a few blocks west of Times Square. Now on his fourth corner of the continental United States, David sees SPUN as a fantastic handheld venue for things urbanites didn’t know they were interested in. This includes hurricane-flaunting concerts, Banh Mi, and optimistic book store openings.

Francesca Giuliani-Hoffman brings a touch of outside perspective to SPUN. Born in Italy and transplanted to the USA in 2010, she is a journalist, a blogger and an alien (immigration-wise and viewpoint-wise). She blogs on theitalien.com and tweets @The_ItAlien. You can find stuff she wrote on CoolHunting, CLOG, BOLD and BreakThru Radio. In the past, Francesca has been a Visiting Scholar at NYU and a Research Scholar at CUNY Queens College, and she graduated with a dissertation on Literary Journalism in 2011 at Luiss Guido Carli University in Rome. She loves people, places, food and the internet. In case you were wondering, she is not related to former mayor Rudy Giuliani.

Bison Messink

Born and raised in Ann Arbor, Michigan, Bison Messink studied writing at Grand Valley State University, and earned an MFA in fiction writing from the University of Wyoming. Previously, he has worked at the Grand Rapids Press, The Ann Arbor News, AnnArbor.com, and Ology.com. In his free time, he eats cold eels and thinks faraway thoughts.

McArthur Joseph is the keeper of Weekend content for SPUN. Hailing from the  “hard knocks” world of Fashion Journalism, he’s worked with a variety of brands in the digital space via positions held at Vibe Magazine and FashionIndie.com. Terms and Conditions

Your Acceptance
The SPUN mobile application enables users to access multimedia content associated with specific locations.  Users can discover content located within a selected city, and, in certain instances, ‘wake up’ content when users pass within a certain distance of its tagged location. These terms and conditions (“Terms and Conditions”) govern your access to and use of the SPUN service (“SPUN” or the “Service”) accessed by way of various mobile and smartphone applications for devices (each an “App”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions.
The Service is owned, operated and maintained by Broadcastr Inc. (“We” or the “Company”).
You agree to accept and to be bound by these Terms and Conditions (including any updates we may implement from time to time) by (i) clicking to accept or agree to these Terms and Conditions when registering to use the Service or (ii) actually accessing and using the Service by way of an App. If you do not agree to these Terms and Conditions, you cannot register for SPUN and please do not further access and/or use the Service.
Eligibility and Access
SPUN is available only to individuals who are at least 13 years old. You represent and warrant that if you are an individual, you are of legal age to form a binding contract, and that any registration information you submit is accurate and truthful. The Company may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.
In using SPUN, you may create an account by linking your existing Facebook account. When creating your account, you must provide accurate and complete information. You may never use another’s account without permission. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify the Company immediately of any breach of security or unauthorized use of your account. You will be liable for any use made of your account or password and the losses of the Company or others due to such unauthorized use. The Company will not be liable for your losses caused by any unauthorized use of your account.  We reserve the right to reject any user name selected by you and/or revoke your right to any previously selected user name and give such user name to any other person or entity in our sole discretion and without liability to you.
Third Party Content
The Service contains content provided by and sourced from third party services and resources (“Third Party Content”) which may be unaffiliated with us. The availability of any Third Party Content through the Service does not imply any endorsement by us of such Third Party Content. By using the Service you acknowledge and agree (i) to assume sole responsibility for and assume all risk arising from your access to, use of or reliance upon any such Third Party Content, (ii) that we are not responsible for the accuracy of such Third Party Content or for the products or services made available in connection with such Third Party Content and  (iii) that we have no liability to you or any third party for any harm, injuries or losses suffered as a result of your access to or use of such Third Party Content.
You are not authorized to (and, for the avoidance of doubt, nothing contained in these Terms and Conditions authorizes you to) exploit, reproduce, publicly distribute, display or otherwise communicate any Third Party Content. The owners of such Third Party Content may have the right to seek damages against you for any unauthorized use of their materials.
Privacy
Your use of the Service makes you subject to the Company’s Privacy Policy, which is available at http://www.getspun.com/privacy and is hereby incorporated by reference into these Terms and Conditions.  Our Privacy Policy provides information regarding our collection and use of your personal information and data. If you have any questions about the Privacy Policy, please contact the Company at feedback@getspun.com.
Ownership
The Service, as well as certain proprietary content within the Service including but not limited to the Company’s trademarks, logos and designs (collectively, “Company Content”) are protected by copyright, trademark, and other laws. Except as expressly provided herein, the Company and its licensors exclusively own all right, title and interest in and to the Service and Company Content, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Service or any Company Content. The term “Company Content” as used herein does not include any Third Party Content (defined above).  The Company claims no ownership interest in any Third Party Content and expressly disclaims any liability concerning those materials.
License Grant
Subject to your compliance with these Terms and Conditions, the Company grants you a limited, non-exclusive, non-transferable license (without a right of sublicense) to access and use the Service for your personal and non-commercial use only.
With respect to any App downloaded by you from Apple’s iTunes Store, the Company grants to you a non-transferable license to use such App on any iPhone, iPod Touch, or iPad, as applicable, that you own or control as permitted by the Usage Rules set forth in the App Store℠ Terms of Service.  You agree to the Apple iTunes Terms of Service if you download the App from the iTunes Store.
Social Networks
The Service has features that allow you to integrate your activities on the Service with functionality offered by third party social networking services, including Facebook and Twitter, to connect your SPUN account to your social networking account. If you connect your SPUN account to a Facebook account, in the preferences pane you can choose whether or not to automatically share your SPUN-related activities to Facebook, including whether or not to share your SPUN-related activities to other SPUN users or to Facebook if you have activated sharing to Facebook. You agree that the Company is not responsible for content (including, but not limited to Third Party Content) once it is shared to Facebook.
Location Based Services
The core of function of SPUN is providing you with print and multimedia materials that are served to you based on location and based on the context of the materials. To enhance the Service we try to exchange your lat/long information to the nearest address through geo rss services. Since SPUN is a geolocation aware service, such location information is subject to abuse, misuse, and over-monitoring by others including, perhaps, by your Facebook “contacts”. Please manage your own mobile device and the profile preferences on Facebook, on an ongoing basis, accordingly. Please see our Privacy Policy for more detail regarding how to manage SPUN’s location-based features.
Restrictions
Except as expressly specified in these Terms and Conditions, you may not (a) copy or modify the App, including, but not limited to, adding new features or otherwise making adaptations that alter the functioning of the App; (b) transfer, sell, rent, lease, distribute, sublicense or otherwise assign any rights to, or any portion of, the App to any third party; or (c) make the functionality of the App available to multiple users through any means, including, but not limited to, distribution of the App or by uploading the App to a network or file-sharing service or through any hosting, application services provider or any other type of service. The App contains trade secrets, and in order to protect those secrets you agree not to disassemble, decompile or reverse engineer the App, in whole or in part, or permit or authorize a third party to do so, except to the extent such activities are expressly permitted by law notwithstanding this prohibition. You will not attempt to circumvent any technical restrictions in the App that limit your use of the App in certain ways.
Updates and Upgrades
You acknowledge that from time to time the Company may issue automatic updates or upgrades to the version of the App you are using on your mobile device in the Company’s sole discretion and that the Company may also disable access to the App for any period of time. You hereby consent to such automatic updating or upgrading on your mobile device. If any upgrade in or to the App requires changes in your equipment or software (including the operating system for your mobile device), you must effect these changes at your own expense. Any new or additional features that augment or enhance the current App, including the release of new products and services, will be subject to the terms and conditions of these Terms and Conditions.
Proprietary Rights.
This copy of the App is licensed, not sold, to you. You agree that the Company and its licensors own all right, title and interest in and to the App, including all intellectual property rights therein, and that the Company retains ownership of all copies of the App even after installation on your mobile device. The App is protected by United States copyright law and international treaties. You will not delete or in any manner alter the copyright, trademark, and other proprietary rights notices or markings appearing on the App as delivered to you.
Export Control.
You may not use, export, re-export, import, or transfer the App except as authorized by United States law, the laws of the jurisdiction in which you obtained the App, and any other applicable laws.
General Prohibitions.
The following uses of the Service, and any attempts at such activities, are expressly prohibited: 
 (i) resale of any software, products or services in whole or in part without the prior written consent of the Company; 
 (ii) furnishing false data including but not limited to false names, addresses and contact details and fraudulent use of credit/debit card numbers; 
 (iii) circumventing security on the Service, including but not limited to, intercepting or accessing data not intended for you, logging into a server or account that you are not expressly authorized to access, or probing the security of other networks; 
 (iv) uploading or distributing viruses or other forms of malware or spyware; 
 (v) use or launch any automated system, including without limitation, ‘robots’, ‘spiders’, and ‘offline readers’, that accesses the Service in a manner that sends more request messages to the Company’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser; or (vi) collection or harvesting of any personally identifiable information, including account names or e-mail addresses, from the Service.
The Company will have the right to investigate and prosecute violations of any of the above, including intellectual property rights infringement and Service security issues, to the fullest extent of the law. The Company may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms and Conditions or the rights of any third party.
Termination
You may terminate the license at any time by destroying all copies of the App in your possession or control. Without limiting any other terms of these Terms and Conditions, the license will automatically terminate without notice from the Company if you breach any terms of these Terms and Conditions. Upon any termination of these Terms and Conditions, you must cease all use of the App and promptly delete and destroy all copies, full or partial, of the App.
Without limiting other remedies, the Company may, at any time, suspend, terminate, or refuse to provide you with access to the Service. In addition, the Company may notify authorities or take any actions it deems appropriate, without notice to you, if the Company suspects or determines, in its own discretion, that you may have or there is a significant risk that you have (a) failed to comply with any provision of these Terms and Conditions or any policies or rules established by the Company; or (b) engaged in actions relating to or in the course of using the Service that may be illegal or cause liability, harm, embarrassment, harassment, abuse or disruption for you, the Company, other users of the Service or any other third parties.
After any termination, you understand and acknowledge that we will have no further obligation to provide the Service and all licenses and other rights granted to you by these Terms and Conditions will immediately cease.
Any suspension, termination or cancellation will not affect your obligations to the Company under these Terms and Conditions (including, without limitation, proprietary rights and ownership, indemnification, and limitation of liability), which by their sense and context are intended to survive and do survive such suspension, termination or cancellation.
Disclaimers; Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” AND IS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. THE COMPANY AND ITS DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS DO NOT WARRANT THAT: (A) THE SERVICE WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS SOLELY AT YOUR OWN RISK. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnity
You agree to defend, indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, members, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses (including but not limited to reasonable attorney’s fees) arising from: (i) your use of the Service; (ii) your violation of these Terms & Conditions; or (iii) your violation of any third party right, including without limitation any copyright, property, publicity or privacy right. This defense and indemnification obligation will survive these Terms & Conditions and your use of the Service.
Proprietary Rights Notices
All trademarks, service marks, logos, trade names, and any other proprietary designations of the Company used herein are trademarks or registered trademarks of the Company. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.
Mandatory Arbitration
The Service and these Terms and Conditions are governed by and must be construed in accordance with the laws of the State of New York, excluding its conflicts of law rules, and the United States of America. Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by arbitration in New York County, New York, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes, who shall be selected from the appropriate list of JAMS arbitrators in accordance with the Arbitration Rules and Procedures of JAMS. The prevailing party in any arbitration or other proceeding arising under these Terms of Use shall be entitled to receive reimbursement of its reasonable expenses (including reasonable attorneys’ fees, expert witness fees and all other expenses) incurred in connection therewith. Judgment upon the award so rendered may be entered in a court having jurisdiction or application may be made to such court for judicial acceptance of any award and an order of enforcement, as the case may be. Notwithstanding the foregoing, each party shall have the right to institute an action in a court of proper jurisdiction for injunctive or other equitable relief pending a final decision by the arbitrator. For all purposes of these Terms and Conditions, the parties consent to exclusive jurisdiction and venue in the United States Federal Courts or state courts located in the Southern District of New York. Use of the Service is not authorized in any jurisdiction that does not give effect to all provisions of these Terms and Conditions, including without limitation, this Section.
No Class Actions.
YOU AND THE COMPANY AGREE THAT YOU AND THE COMPANY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. FURTHER, YOU AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OF MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING, AND THAT IF THIS SPECIFIC PROVISO IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THE MANDATORY ARBITRATION SECTION ABOVE SHALL BE NULL AND VOID.
Equitable Relief.
The foregoing provisions of these Terms and Conditions do not apply to any claim in which the Company seeks equitable relief of any kind. You acknowledge that, in the event of a breach of these Terms and Conditions by the Company or any third party, the damage or harm, if any, caused to you will not entitle you to seek injunctive or other equitable relief against the Company, and your only remedy shall be for monetary damages, subject to the limitations of liability set forth in these Terms and Conditions.
Entire Agreement
These Terms and Conditions, together with the Company’s Privacy Policy and any other legal notices published by the Company on the Service, shall constitute the entire agreement between you and the Company concerning the Service and supersede all prior or contemporaneous communications and proposals (whether oral, written or electronic) between you and the Company.
Assignment
These Terms & Conditions, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but the Company may assign, transfer or delegate any of its rights and obligations hereunder without restriction.
Notices
You consent to the use of: (a) electronic means to complete these Terms and Conditions and to deliver any notices or other communications permitted or required hereunder; and (b) electronic records to store information related to these Terms and Conditions or your use of the Service. Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms and Conditions, will be in writing and given by the Company (x) via email if applicable (in each case to the address that you provide); or (y) by posting to the Service. For notices made by e-mail, the date of transmission will be deemed the date on which such notice is transmitted.
Modification.
We reserve the right to amend these Terms and Conditions at any time and without prior notice, and it is your responsibility to review these Terms and Conditions for any changes. If we modify these Terms and Conditions, we will post the modification within your App or otherwise provide you with notice of the modification.Your use of the Service following any amendment of these Terms and Conditions will signify your assent to and acceptance of its revised terms and your only recourse if you do not accept the revised terms is to immediately discontinue using the Service.  If the modified Terms and Conditions are not acceptable to you, your only recourse is to cease using the Service. No revisions to these Terms and Conditions will apply to any dispute between you and us that arose prior to the date of such revision.
General.
The heading references used in these Terms and Conditions are for convenience purposes only, do not constitute a part of these Terms and Conditions, and shall not be deemed to limit or affect any of the provisions hereof. The failure of the Company to enforce any right or provision of these Terms and Conditions will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Company. Except as expressly set forth in these Terms and Conditions, the exercise by either party of any of its remedies under these Terms and Conditions will be without prejudice to its other remedies under these Terms and Conditions or otherwise. If for any reason a court of competent jurisdiction finds any provision of these Terms and Conditions invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms and Conditions will remain in full force and effect. There are no third-party beneficiaries of these Terms and Conditions unless provided expressly by this agreement. You agree that no joint venture, partnership, employment, or agency relationship exists between you and the Company as a result of these Terms and Conditions or your use of the Service.

Broadcastr Inc. (“Broadcastr”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of our SPUN software applications (including any updates, new versions or new releases thereof) for use on mobile devices including, but not limited to, Apple’s iPad and iPhone (each a “SPUN Application”) and any other services offered by Broadcastr in connection with a SPUN Application (collectively, the “Services”). This Privacy Policy applies only to information that you provide to us through the Services.
This Privacy Policy may be updated from time to time to reflect industry initiatives, changes in the law or other purposes as determined by us. We will notify you of any material changes by making the new Privacy Policy available via our Services.  All such material modifications will apply prospectively only.  Your continued use of the Services after the posting of any updates signifies your acceptance of the revised Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes.
COLLECTION AND SUBMISSION OF PERSONAL INFORMATION AND NON-IDENTIFYING INFORMATION ON SPUN
In the course of using the Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you and administer your use and enjoyment of the Services (“Personal Information”). Personal Information may include, but is not limited to, your name, phone number, mailing address and email address. We use your Personal Information mainly to provide the Services and administer your inquiries.
We also collect the other information that you provide as part of registration and the administration and personalization of your user experience (e.g., without limitation, zip code or and individual preferences) (“Non-Identifying Information”).
We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide the Services and administer your inquiries.
Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non- identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other SPUN users to attempt to provide you with a better experience, to improve the Services and to analyze and understand how our Services are used. We may also use the combined information without aggregating it to serve you specifically, for instance, to deliver information to you according to your preferences or restrictions.
User IDs. [When you launch the SPUN App, we create a unique identification number associated with you (“User ID”). If you have a SPUN Account and are signed into that Account when you launch the SPUN App, your SPUN user name will be associated with your User ID. We use and store your User ID to enable you to interact with and use our Services and to make it possible to authenticate and understand the use of our Services. We link your User ID with the technical information accessed through your use of the Services which enables us to administer your account or to delete information when you request that we do so or for other administrative purposes.
Log Data. When you use the Services, our servers automatically record information about your activity on the app (“Log Data”). This Log Data may include information such as your mobile device’s Internet Protocol (“IP”) address, actions performed in the app, the time spent in the app, information you search for through the Services, access times and dates, and other statistics. We use this information to monitor and analyze use of the Service and for the Services’ technical administration, to increase the Services’ functionality and user-friendliness, and to better tailor it to our users’ needs. For example, some of this information is collected so that when you use the Services again, it will recognize you and the Services will serve information appropriate to your interests. We do not treat Log Data as Personal Information but we may use in association with other information and we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.
Location Based Information.  The core function of SPUN is to provide users with text and multimedia materials that are associated with a specific location.   Users can discover content located within a selected city, and, in certain instances, ‘wake up’ content when users pass within a certain distance of its tagged location.  In order to provide these core functions within the Services, we monitor, collect and use your wireless location information, based on the approximate location of your mobile device, referred to as Location-Based Services, or “LBS”.  You acknowledge and agree that we may retain a history of your location(s) in connection with your use of the Services.  We will use your location history for the purposes of helping us provide you with content we believe you will find of interest in light of your past use of the Services.  You may review and delete this user history by emailing us at feedback@getspun.com.
Our Policy Toward Children
If a parent or guardian becomes aware that his or her child under 13 has provided us with Personal Information without their consent, he or she should contact us at feedback@getspun.com and we will endeavor to delete that information from our databases. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information.
Information Sharing and Disclosure
Third Party Social Networks. As a SPUN user who has downloaded and installed our SPUN Application on your mobile device you can interact with and use third party social networks including but not limited to services like Facebook and Twitter. When you broadcast information to such third party services, such information is no longer under the control of Broadcastr and is subject to the terms of use and privacy policies of such third parties, which we encourage you to read. You acknowledge that if you choose to use these social networks, your friends, “followers” and subscribers on any such social networking services will be able to view such activity which, depending on your preferences and use of the Services may include (but is not limited to) activities such as (i) sharing content, (ii) sharing links to purchase the App and (iii) “liking” certain content viewed using the App.   You have the ability to disable the connection between your SPUN Application and a third party social network you’ve chosen to access at any time via the settings menu in the SPUN Application interface.
Aggregate Information and Non-Identifying Information. We may share aggregated information that includes Non-Identifying Information and Log Data with third parties for industry analysis, including analysis of how our Services are used, demographic profiling, and to deliver targeted advertising about other products and services. Any aggregated information shared in these contexts will not contain your Personal Information.
Services Providers. We may employ third party companies and individuals to facilitate our Services (e.g., without limitation, maintenance services, database management, web analytics and improvement of our Services’ features), to provide the Services on our behalf, or to assist us in analyzing how Services are used. These third parties would have access to your Personal Information only to perform these tasks on our behalf and in each such case will be obligated not to disclose or use it for any other purpose.
Compliance with Laws and Law Enforcement. Broadcastr cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Broadcastr or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, any illegal, unethical or legally actionable activity.
Business Transfers.  From time to time Broadcastr may purchase a business or one or more of our businesses may be sold, and your Personal Information may be transferred as part of such purchase or sale.
Changing or Deleting Your Information
You may email us at feedback@broadcastr.com with a request that we delete your Personal Information. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for legitimate business purposes.
You may limit Broadcastr’s use of your personal data for direct marketing purposes. You may also request access to, correction of, or deletion of personal data. Security
Broadcastr takes reasonable steps to protect your Personal Information.  However, since no Internet, email or other electronic transmission is ever completely secure or error-free, we advise you to take special care in deciding what information you send to us in this way.  You are responsible for maintaining the secrecy of your login information to help prevent others from accessing your Personal Information.
Phishing
Identity theft and the practice currently known as “phishing” are of great concern to Broadcastr. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Our Services (and the content you may access through them) contains links to various websites and online services.
